• The Provider – Demi Spaccavento / Bright Girl Health
• The Course – The ‘Find Your Fertile Window’ online self-paced course and all related material

Disclaimer

Demi Spaccavento is a fertility awareness trainer, certified with a certificate of theory from the NFPTA (Natural Family Planning Teachers Association). The Customer understands Demi Spaccavento (and Bright Girl Health) is not a doctor, registered dietician, therapist, nutritionist, naturopath, psychotherapist, employee, agent, or lawyer. The Customer understands that their participation in The Course will not treat or diagnose any disease, illness, or ailment and if they should experience any health issues they should see their registered physician or qualified health practitioner for individualised care.

The fertility awareness information presented in this training is not medical advice. If you require medical advice, please seek the care of a qualified health practitioner. 
The Customer understand that this engaging with course does not guarantee that the fertility awareness method will work for their goals, or have any particular result.

Statement of responsibility

The Customer understands, acknowledges, and agrees that neither Demi Spaccavento or Bright Girl Health have promised or represented in any way that as a result of purchasing The Course The Customer:

1. Will not experience an unplanned pregnancy
2. Will experience a planned or desired pregnancy
3. Is healthy or free from any health care risk
4. Will or will not be protected in any manner against AIDS or any other sexually transmitted infections
5. Will procure any publicity, social media exposure, interviews, write-ups, features, television, or print promotions. The customer understands that a relationship does not exist between the Parties as a result of purchasing The Course.

The Customer clearly acknowledges and agrees that The Customer personally assumes all risk and/or legal liability related to The Customer’s use or implementation of this information. The Customer clearly acknowledges and agrees that the accuracy, completeness, usefulness of the fertility awareness method and the application of and reliance on the information customer learns throughout any of The Course is at The Customer’s own risk.

The Customer agrees that they are over the age of 18 and are capable of entering into this agreement, assuming all risks and responsibilities.

The Course is for strictly educational purposes only. The customer accepts and agrees that customer is 100% responsible for their progress and results from the Course. The Provider makes no representations, warranties, or guarantees verbally or in writing.
The Customer understands that the results of The Course experienced by each customer may significantly vary. The Provider assumes no responsibility for errors or omissions that may appear in any program materials.

Statement of Informed consent

The Customer understands:

I understand that Demi Spaccavento is not a Medical Doctor/Naturopath and/or Nutritionist.

I understand that I am free to accept or reject any advice and/or suggestions recommended to me in The Course.

I understand that I am encouraged to work jointly and collaboratively with other health professionals as needed at any point during this program/the Course.

I understand that I am fully responsible for any and all possible risks, injury and complications that may arise from any and all advice, or treatments recommended to me in The Course.

I understand that participating in The Course in no way guarantees that I will not experience an unplanned pregnancy.

I understand that participating in The Course in no way guarantees that I will experience a planned or desired pregnancy.

Limitation of liability

he Customer agrees they use this Course and The Provider’s resources at their own risk and that the Course is only an educational resource. Customer releases The Provider, its officers, employees, directors, subsidiaries, principals, agents, heirs, executors, administrators, successors, assigns, Instructors, guides, owners, executives, agents, staff, participants, and related entities, from any and all damages that may result from any claims, all actions, causes of action, contracts, claims, suits, costs, demands and damages of whatever nature or kind in law or in equity arising from The Customer’s participation in The Course. 

The Customer accepts any and all risks, foreseeable or unforeseeable.

The Customer agrees that The Provider will not be held liable for any damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of The Provider’s Course or enrollment in The Course. The Provider assumes no responsibility for errors or omissions that may appear in any of The Course materials.

Indemnification

he Customer shall defend, indemnify, and hold harmless The Provider (Bright Girl Health, Demi Spaccavento), Provider’s officers, employers, employees, contractors, directors, related entities, trustees, affiliates, and successors from and against any and all liabilities and expense whatsoever – including without limitation, claims, damages, judgments, awards, settlements, investigations, costs, attorneys fees, and disbursements – which any of them may incur or become obligated to pay arising out of or resulting from the Courses, offering for sale, the sale, and/or use of the product(s), excluding, however, any such expenses and liabilities which may result from willful misconduct by The Provider.

In consideration of and as part of The Customer’s payment for the right to participate in The Course, The Customer, your heirs, executors, administrators, successors and assigns do hereby release, waive, acquit, discharge, indemnify, defend, hold harmless and forever discharge Demi Spaccavento and Bright Girl Health, and its subsidiaries, principals, directors, employees, agents, heirs, executors, administrators, successors, and assigns and any of the training instructors, guides, staff or students taking part in the training in any way of and from all actions, causes of action, contracts, claims, suits, costs, demands and damages of whatever nature or kind in law or in equity arising from The Custmer’s participation in The Course.

No transfer of intellectual property

The Course and all materials are copyrighted and original materials that have been provided to customer for The Customer’s individual use only and a single-user licence. 

The Customer is not authorised to use any of The Provider’s intellectual property for The Customer’s business purposes. 

All intellectual property, including The Provider’s copyrighted program and/or course materials, shall remain the sole property of the Demi Spaccavento. No licence to sell or distribute The Provider’s materials is granted or implied. 

By purchasing this product, The Customer agrees, (1) not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights, (2) that any Confidential Information shared by The Provider is confidential and proprietary, and belongs solely and exclusively to The Provider, (3) customer agrees not to disclose such information to any other person or use it in any manner other than in discussion with The Provider. 

Further, by purchasing this program, The Customer agrees that if customer violates, or displays any likelihood of violating, any of customer’s Agreements contained in this paragraph, The Provider will b

Prohibited use

You may only use the material provided as part of this product for lawful purposes.

You may not use this course and related material:

• To copy, aggregate, database scrape or use in any fashion our copyrighted content, images and marks without our express prior written approval;
• In any way that breaches any applicable local, national or international law or regulation;
• To modify, reverse engineer, decompile or disassemble The Course or take any measures to damage or replicate them;
• In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
• To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (i.e. spam)
